PMG PTY LTD ACN 081 343 259 and its related bodies corporate (“the PMG Group”) (together, “PMG”, “we”, “our” and “us”) (136 Cathedral Street, Woolloomooloo, Sydney NSW 2011) respects individual privacy and the rights of individuals to control their personal information. We are committed to protecting your personal information. This Privacy Policy sets out our policies and practices regarding the collection, use and disclosure of personal information that you provide to us and which we collect from you. By accessing or otherwise using the website at https://www.homeofpmg.com (“Website”), contacting us by email, telephone or using applications or websites owned or controlled by us, all products, software, data feeds, plugins, mobile applications and other applications and services provided from time to time on, from or through the Website (together, the “Service”), or engaging with us in any other way, you agree to the terms and conditions set out in this Privacy Policy and consent to the processing of your information in accordance with this Privacy Policy and any other arrangements that apply between us.

The purpose of this Privacy Policy is to set out the open and transparent approach PMG takes in relation to the treatment and management of Personal Information; as well as to outline the measures PMG has implemented to safeguard the privacy of those individuals who voluntarily submit their personal information, whilst complying with its obligations under the relevant privacy laws. This Privacy Policy includes information on how PMG collects and receives, uses, discloses and keeps secure, individuals’ personal information; it also covers how PMG makes the personal information it holds available for access to and correction by the individual.

Types of personal information we collect and hold

“Personal information” is information or an opinion about you or which is reasonably identifiable as you, whether or not the information or opinion is true and whether or not the information is recorded in a material form.

The type of personal information PMG may collect and hold about an individual depends on the type of dealings that individual has with PMG. For example, if an individual:

  • Enters a promotion, we will collect the individual’s information submitted by the individual in connection with the promotion entry through a third-party website or mobile application;
  • Gets in touch with an enquiry, we will record details about the individual and the nature of the enquiry being made;
  • Is a supplier of PMG, we will collect contact address details, including all forms of contact and address, billing information and information about the goods and/or services they supply; and
  • Applies for a role at PMG, we will collect the information the individual includes in their application for employment, including their cover letter, resume, contact details and referee reports, which are then stored with PMG.
  • Makes a purchase with one of our client’s using a platform, portal or website developed or administered by PMG, we will collect the individual’s information required by our client to be provided by the individual to make the purchase.

The types of personal information that we may collect includes:

  • name, address, email address, telephone number and other contact details;
  • age and gender;
  • drivers licence and passport numbers;
  • car registration details;
  • bank accounts details, including account name, BSB and account number;
  • current employment status, your occupation and length of employment, level of education, your employment history;
  • your answers to assessment questions;
  • records of our interactions with you;
  • your computer and connection information, statistics on page views and other standard web log information;
  • any other personal information that may be required in order to facilitate your dealings with us;
  • any other personal information you may be volunteer.

We may collect personal information about:

  • individuals;
  • contractors and suppliers;
  • third parties seeking or using our Service;
  • other people who come into contact with us in the ordinary course of business; and
  • applicants applying for a job or position with us: we may collect certain information from you (including your name, contact details, working history and relevant records checks) from any recruitment consultant, your previous employers and others who may be able to provide information to us to assist in our decision whether or not to make you an offer of employment or engage you under a contract. This Privacy Policy does not apply to acts and practices in relation to employee records of our current and former employees, which are exempt from the Privacy Act.
How we collect and hold personal information

In general, we do not collect your personal information, unless you provide it to us voluntarily and knowingly during your dealings with us, including by way of:

  • when you voluntarily use the Service;
  • personal contact with us at a face-to-face meeting or situation (for example, at job interviews, supplier meetings and client meetings);
  • when you provide us with personal information to enter or participate in a campaign, competition or promotion. This information is securely transmitted using encryption protocols, processed, and stored in a protected database. Access to this data is restricted to personnel authorised by PMG (including the PMG client to which the promotion relates) and is used solely for administering the promotion and related communications;
  • purchasing a product from one of our client’s using a platform, portal or website developed or administered by PMG,
  • through third parties (such as direct marketing databases);
  • correspondence, chats, social applications or services, mail, email or telephone;
  • when you invest in our business or enquire about a potential acquisition of our business.

In some cases, we collect personal information from third parties including public sources, our related companies and our service providers.

We may hold your personal information in hard copy files and/or electronic files.

Security

We take reasonable steps to ensure that all personal information that we collect is kept secure in accordance with industry standard physical, electronic and managerial procedures. All of our staff are trained to comply with this Privacy Policy. In respect of personal information collected online or stored electronically (including in the cloud) in particular, you acknowledge that no security system is impenetrable and that the security of such networks and systems can never be guaranteed. We also cannot guarantee that the information you supply will not be intercepted while being transmitted over the internet. Accordingly, any personal information which is transmitted to us is transmitted at your own risk.

Why we collect, hold, use and disclose your personal information

We will use and disclose your personal information only for the purpose (the “primary purpose”) for which you provide it to us, which may include:

  • vide you with any services that you may request including enabling you to access and the Service from time to time;
  • supply employees of member organisations and individuals who obtain PMG products and services directly from PMG, with information and details of its products and services; as well as for campaign management and promotional prize fulfilment;
  • to respond to any query or complaint that you may make or otherwise provide customer support;
  • accounting purposes;
  • business planning and product development;
  • transfers and sharing of personal information within the PMG Group;
  • for internal administration and operational purposes such as preventing fraud and abuse of our systems and to troubleshoot bugs;
  • to operate, protect, improve and optimise the Service and our business such as to perform analytics, conduct research, evaluation and development and quality control purposes and for advertising and marketing;
  • to consider your employment or contractual engagement application.
Who we may disclose your personal information to

PMG may disclose personal information within the PMG Group and to third parties where appropriate for the purposes set out in this policy; these third parties include, but are not limited to:

  • financial institutions for payment processing;
  • prize fulfilment agencies;
  • PMG’s clients on behalf of whom PMG collects data in connection with a promotion, campaign or other services. PMG recommends that, before you enter a promotion or campaign run by a third party promoter, you read the privacy policy of that third party;
  • educational service providers;
  • enforcement or regulatory authorities, within and outside of Australia, if required by law, (such as Liquor and Gaming NSW, the Australian Taxation Office, Centrelink and Department of Immigration and Citizenship);
  • referees whose details are provided to PMG by job applicants;
  • PMG’s contracted service providers;
  • third party contractors engaged to perform functions or provide services relating to the purposes for which we collect personal information. If this is the case, we will take reasonable steps to ensure that they comply with this Privacy Policy;
  • third party service providers or affiliates within or outside of Australia who work on behalf of or with us to provide some of our administrative and other services, such as processing payments (such as credit card payments). We require such service providers to agree not to use such information except as necessary to provide the services to us;
  • insurers, professional advisers, dealers and agents; and
  • any party to whom our assets or business may be transferred or with whom we are merged.

PMG may disclose personal information to third parties located overseas in situations including the following:

  • where PMG’s client is based or has operations located overseas, and that client requires personal information collected by PMG in connection with the client’s campaign (for example, personal information collected by PMG in promotion entries) to be provided to the client, it’s overseas offices or affiliates;
  • data collection (for example, names, training hours and titles for global statistics);
  • where cross border campaigns require local storing of personal information; and
  • where cross border suppliers oversee prize fulfilment on behalf of PMG or its affiliates.

PMG is committed to comply with the requirements of the Privacy Act that apply to cross border disclosure of personal information, as well as with any legal requirements applicable in the relevant jurisdiction.

PMG may also disclose of personal information (including sensitive information) to avoid an imminent threat to an individual’s life or to public safety; we will also disclose personal information if required by law, including compliance with warrants, subpoenas or other legal process.

In the rare event that PMG is required to disclose personal information to law enforcement agencies, government agencies or external advisors, PMG will do so in accordance with the Privacy Act and will not disclose of government related identifiers (such as a Medicare number or driver’s license number), unless it is required or authorised by or under an Australian law or court/tribunal order.

PMG requires persons and companies to which it discloses personal information to restrict their use of such information to the purposes for which it has been provided by PMG and not to disclose of that information to others.

Secondary purpose

We will not use or disclose your personal information for any secondary purpose, unless you consent to that use or disclosure; or you would reasonably expect the use or disclosure in the circumstances, and that secondary purpose is related to the primary purpose for which we have collected that information. Except as set out in this Privacy Policy (or as required for by any statutory or legal requirements), we do not share, sell, rent or otherwise disclose your personal information to third parties.

While we do not use browsing information to identify you personally, we may use cookies, web beacons, and other tracking technologies to collect certain information about your use of the Service such as the pages you visit, the date and time of your visit, your IP address and your interaction with the website.
